Silk&Silver Jewelry Webshop terms and conditions

 

These terms and conditions (hereafter the “Agreement”) contains the terms and conditions of the use of Silk&Silver Jewelry Webshop at www.silkandsilver.com (hereafter the “Webshop”) owned by Dilek Platin (hereafter “Silk&Silver Jewelry”). When a person (hereafter the “User”) orders a product or products from the Webshop (hereafter the “Products”), the User agrees to be bound by the Agreement.

The use of the Webshop

 

The User must be eighteen (18) or older to order Products from the Webshop.

 

After the User has placed an order at the Webshop, the User will receive a confirmation e-mail from Silk&Silver Jewelry and a binding sales agreement is reached between the User and Silk&Silver  Jewelry. The said confirmation e-mail will be sent to that e-mail address as provided by the User in the respective order.

 

The User is responsible for all activities occurred under its account. The User warrants that the information provided during the ordering process is true and correct.

 

The content of the Webshop (including without limitation drawings, pictures, sounds, films, graphics and text) is the property of Silk&Silver Jewelry and protected by copyrights and other intellectual property rights. Silk&Silver Jewelry grants to the User a limited license to access and make personal use of the Webshop. The User shall not have the right to download, reproduce, transfer, transmit, duplicate, sell or modify the Webshop or any portion of it without express prior written consent of Silk&Silver Jewelry. The User shall have the right to print and download this Agreement for its personal use.

 

Silk&Silver Jewelry’s Terms of use for the website also apply to the Webshop.

 

Payment methods

For payment with credit cards, the User is charged in real time, through the payment gateway. Silk&Silver Jewelry is using secure payment system of leading financial entities in electronic commerce in order to keep up maximum security of the payment (SSL technology). Silk&Silver Jewelry does not have access to the User’s credit card numbers and they will not be saved on Silk&Silver Jewelry’s database, not even temporarily. 

In order to pay the Products with a Visa Electron card, the Verified by Visa service for online payments must be activated. The Webshop verifies all the credit card transactions before delivering the Products to the User. Silk&Silver Jewelry reserves the right to reject any order if Silk&Silver Jewelry has not been able to verify the credit card transaction.

 

Product Prices

 

The Product price is the price displayed for the Product at the Webshop at the time of ordering.

The shipping fees are as follows:

·       Delivery inside turkey $5,90

·       EU deliveries $15,00 

·       Other international deliveries $19,00

 

The said fees can be seen in the shopping basket page separately for each Product.

All the Product prices and delivery charges are displayed in us dollars ($).

If the Products are delivered to destination outside Turkey, the User is responsible for any customs fees, import duties or other comparable costs. The User acknowledges that the customs policies vary widely from country to country. The User should contact the local customs office for further information. When customs clearance procedures are required, the User is responsible for charges related thereto and the User acknowledges and agrees that it can cause delays beyond Silk&Silver Jewelry’s original delivery estimates.

 

Delivery time

 

Silk&Silver Jewelry processes the purchase orders made by the User within seven (7) working days except customized jewelery. All Products will be delivered to the User with EMS-service. Delivery time is subject to availability of the Product and order destination. An estimated delivery time is provided in the order confirmation. The User acknowledges that an average delivery time for an EMS-service is 3-8working days. After dispatching the order Silk&Silver Jewelry will send a tracking code to the User's email address to ease the delivery progress follow-up. Silk&Silver Jewelry will deliver the Products to the address provided in the purchase order. Silk&Silver Jewelry warrants that all EMS -shipments are insured.

 

Provided that Product delivery will delay significantly, Silk&Silver Jewelry’s customer service will contact the User via the email as provided in the purchase order by the User. 
 

Silk&Silver Jewelry reserves the right to deliver different Products ordered in the same time separately.
 

In case the Product has not arrived and the User has not been contacted by Silk&Silver Jewelry’s customer service, the User is recommended to contact Silk&Silver Jewelry at info@Silk&Silverjewelry.com or by phone +90 (532) 447 43 53 

 

Silk&Silver Jewerly reserves the right to reject any order. In such cases the payments made by the User will be returned to the credit card account within 30 days.

 

Warranty

 

All Silk&Silver Jewelry's Products carry a 5 year warranty against defects in materials and workmanship. Silk&Silver Jewelry’s warranty provided herein does not include normal tear and wear due to use of the Product. Furthermore, Silk&Silver Jewelry’s warranty does not include defects due to negligence in products care. Cancellation and Product Returns

 

The User shall have the right to cancel the order before the Product is delivered to the User. If the User wishes to cancel its order, the User must contact Silk&Silver Jewelry’s customer service by email and to include its name, address and order number in the email. Silk&Silver Jewelry will return the payments made the User’s credit card account within 30 days.

 

The User has the right to return or exchange a Product within fourteen (14) days from the day when the User received the Product. This return policy does not cover Products which are produced or altered in accordance with the User’s wishes. The User has the right to return a Product if 
 

(i)the order has been cancelled according to this Agreement by notifying Silk&Silver Jewelry’s customer service at webshop@Silk&Silverjewelry.com within fourteen (14) days of the Product delivery, or the Product has been shipped to Silk&Silver Jewelry within said fourteen (14) days for returning purposes;

(ii)the Product has not been used;

(iii)the Product is in identical condition that the User received it and all the parts (if any) of the Product are included in the package; and

(iv)the Product has been repackaged into its original package.
 

The Product must be returned to Silk&Silver Jewelry as soon as possible after cancellation. When returning the Products the User will be responsible for risk of damages during the return delivery. Silk&Silver Jewelry shall reimburse to the User the costs that arise out of the return shipment, The price of the returned Products paid by the User will be refunded to the User’s credit card. The reimbursement will take place as soon as Silk&Silver Jewelry has received and inspected the returned Products, however no later than within thirty (30) days from the day when Silk&Silver Jewelry has received the returned Products. 
 

If the Product is faulty or damaged during the shipment, the User must inform Silk&Silver Jewelry’s customer service about said defect as soon as the User has noticed the defect.Silk&Silver Jewelry endeavours to replace the faulty or damaged Product, but if this is not possible Silk&Silver Jewelry will reimburse the User with the full amount of costs paid by the User. Silk&Silver Jewelry will not reimburse the User with the costs before Silk&Silver Jewelry has confirmed the defect in the Product. The User is recommended to contact Silk&Silver Jewelry’s customer service in order to receive more instructions with this respect.

 

Privacy policy

 

Silk&Silver Jewelry respects the User’s privacy. The personal data and other information received from the User via the Webshop is used only by Silk&Silver Jewelry, except in cases where Silk&Silver Jewelry uses third parties to perform certain functions, such as credit card processing, delivering Products and fulfilling orders. In such cases Silk&Silver Jewelry provides only such information necessary for the third party to perform its specific functions.

 

Silk&Silver Jewelry does not transfer any personal data or other information received from the User to a third party for any other purpose than processing the purchase order. Silk&Silver Jewelry does not sell, share, lease or rent such information to any third party for any reason.

Silk&Silver Jewelry reserves the right to transfer personal data and other information received from the User to the authorities in the case of infringement of applicable laws and regulations.

 

The User’s name, contact information and other personal data provided will be stored at Webshop's customer register. The use of customer register information is described in the respective description of the data file as specified here.

The User has the right to examine, change and delete its personal data stored to the customer register. The User has the right to examine its personal data stored to the customer register for free once a year by sending Silk&Silver Jewelry a written application. Silk&Silver Jewelry will use the User’s personal data in order to process the Product Orders.

 

Silk&Silver Jewelry may use the User’s personal data received from the User for marketing purposes. The User has the right at any time to prohibit Silk&Silver Jewelry from continuing the marketing of its products.

 

Changes to the Webshop and the Agreement

 

Silk&Silver Jewelry reserves the right to make changes to the Webshop, its polices and the Agreement at any time. If the Agreement is changed, Silk&Silver Jewelry will post a notification of the said change at the front page of the Webshop. Modified Agreement will apply to all orders made after the notice is posted to the front page of the Webshop. 

 

Force Majeure

 

Silk&Silver Jewelry shall not be liable for any breach of its obligations under this Agreement or delays in performing or failure to perform in accordance with this Agreement, which are attributable to causes beyond Silk&Silver Jewelry’s reasonable control, including without limitation fires, strikes, labor disputes, wars, natural catastrophe, acts or interventions by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, network failure or malfunction.

 

Liability and Mandatory Consumer Legislation

 

Silk&Silver Jewelry is not liable for indirect or consequential damages, unless caused by willful misconduct or gross negligence. This limitation of liability shall not limit Silk&Silver Jewelry’s liability for death or personal injury caused by negligence act.

Nothing contained in this Agreement shall limit the User’s rights under the applicable mandatory consumer legislation.

 

Applicable Law and Disputes

 

This Agreement is governed by and construed in accordance with the laws of Turkey, excluding its choice of laws provisions. Any dispute arising out of or related to this Agreement shall be settled in Turkey at the Bursa district court.
